General Terms and Conditions

§ 1 Scope and Provider
These General Terms and Conditions apply to all bookings, orders, and contracts for services provided by JustInVentures GmbH, Pfarrer-Brendel-Platz 7, 97274 Leinach (“BOOSTER LOUNGE”), place of business Theresienstraße 152, 80333 Munich. They apply to consumers within the meaning of § 13 of the German Civil Code (BGB). Deviating terms of the customer shall not become part of the contract unless their validity is expressly agreed in text form.
§ 2 Services and Information
(1) BOOSTER LOUNGE offers wellness infusions and injections with selected micronutrients. The services serve general well-being and do not constitute a substitute for medical diagnosis, advice, or treatment.
(2) Participation in a mandatory information and screening consultation is required before every treatment. No treatment can take place without it.
(3) Our Heilpraktiker (alternative health practitioners) and the trained specialist staff are entitled to refuse or discontinue a treatment for health or safety reasons. In such cases the customer has no claim to performance of the treatment; amounts already paid for the treatment not carried out will be refunded without undue delay using the original means of payment. At the customer's express request, we will credit the amount to their balance instead.
§ 3 Minimum Age
The services of BOOSTER LOUNGE are intended exclusively for persons of legal age (18 years and older). BOOSTER LOUNGE is entitled to request suitable proof of age and to refuse treatment if such proof is not provided.
§ 4 Booking and Conclusion of Contract
(1) Bookings are made via the online booking system or on site. The presentation of services does not constitute a binding offer.
(2) By completing a booking, the customer submits a binding offer. The contract is concluded upon confirmation of the booking by BOOSTER LOUNGE (e.g. by confirmation email); confirmation is issued without undue delay and at the latest within two working days of receipt of the booking. If the customer does not receive confirmation within this period, they are no longer bound by their offer; any amounts already paid will be refunded.
(3) The customer may choose between payment in advance (online) and payment on site. For payment on site, the customer registers a valid means of payment during booking; this serves to secure the booking and will be charged solely in accordance with § 6. For payment in advance, the treatment or purchase price is collected during booking via the payment service provider.
§ 5 Prices and Payment
(1) The prices stated in the booking system at the time of booking apply. All prices are final prices including statutory VAT.
(2) The following means of payment are accepted via our external payment service provider, in particular: credit and debit cards, Apple Pay, Google Pay, PayPal, and Klarna. The availability of individual payment methods may vary depending on device, country, and booking process.
(3) By registering the means of payment, the customer agrees that any fees under § 6 may be charged to the registered means of payment.
(4) The personal “Find Your Boost” guidance is a chargeable service at the price stated in the booking system. It may be paid online in advance or on site. If the customer takes a boost immediately following the guidance and during the same visit, the amount paid for the guidance is credited against the price of that boost. If the customer does not take a boost, the amount remains with BOOSTER LOUNGE as remuneration for the guidance provided. § 6 applies unchanged to cancellation, rebooking, and no-show.
(5) BOOSTER LOUNGE may issue discount codes (promotional codes). A discount code reduces the price of the eligible service; it is not a means of payment, has no monetary value, and is neither paid out nor refunded. The conditions of the respective campaign — in particular the eligible services, any minimum order value, the validity period, the total number of redemptions, and the number of redemptions per person — follow from the campaign under which the code is issued. One discount code may be redeemed per booking transaction; discount codes cannot be applied to Booster Packs or to the purchase of vouchers. The discount amount is fixed bindingly at the time of booking; later changes to or the end of the campaign have no retroactive effect on bookings already made. Cancellation fees under § 6 (3) and (4) are calculated on the price actually payable after deduction of the discount. If a discounted appointment is cancelled, the redemption of the code is reversed; there is no claim to a renewed redemption outside the campaign conditions. For the participation of discounted treatments in the loyalty programme, § 9 (2) applies.
§ 6 Cancellation, Rebooking, and No-Show
(1) Appointments may be cancelled free of charge up to 48 hours before the start of the appointment.
(2) For cancellations between 48 and 24 hours before the start of the appointment, a flat cancellation fee of €10 per booked seat will be charged.
(3) For cancellations between 24 and 12 hours before the start of the appointment, a cancellation fee of 50% of the treatment price will be charged.
(4) For cancellations less than 12 hours before the start of the appointment, as well as for no-shows, a cancellation fee of 100% of the treatment price will be charged.
(5) With regard to the fees under paragraphs 2 to 4, the customer expressly reserves the right to prove that BOOSTER LOUNGE incurred no damage or substantially less damage; in this case the respective fee is waived or reduced accordingly.
(6) Rebooking is possible up to 12 hours before the start of the appointment. The first two rebookings per booking are free of charge. From the third rebooking onward, BOOSTER LOUNGE may charge a rebooking fee of €20 per rebooking; the customer will be informed of any such fee before the rebooking is completed. Also with regard to the rebooking fee, the customer expressly reserves the right to prove that no expense or substantially less expense was incurred; in that case the fee is waived or reduced accordingly. Rebooking less than 12 hours before the start of the appointment is not possible; the cancellation terms apply accordingly.
(7) If the service was paid in advance (e.g. online or by voucher), the fee is offset against the amount paid or the voucher credit; for service vouchers, the value of the voucher (§ 7 (4)) counts as the credit. Any remaining balance is refunded or re-credited. For sessions paid from a Booster Pack, § 8 (6) applies exclusively.
(8) Fees under this § 6 that are not offset in accordance with paragraph 7 are invoiced to the customer and fall due within 14 days of receipt of the invoice. Where a means of payment is registered in accordance with § 4 (3), they may instead be charged to that means of payment.
(9) By way of derogation from paragraphs 1 to 4 and 6, appointments may be cancelled and rebooked free of charge within 15 minutes of completing the booking (correction window). During this period, no fees under paragraphs 2 to 4 and no rebooking fee under paragraph 6 are incurred; the restriction that rebooking is not possible less than 12 hours before the start of the appointment does not apply during this period. The start of the period is determined by the time the booking is received by BOOSTER LOUNGE. If an appointment is rebooked, the correction window of the original booking continues to run; it does not start anew. After the correction window expires, paragraphs 1 to 8 apply unchanged.
§ 7 Vouchers
(1) BOOSTER LOUNGE offers value vouchers (for a monetary amount) and service vouchers (for a specific service).
(2) Vouchers are valid for three years from the end of the year of purchase.
(3) Value vouchers are transferable. Cash payment of the voucher value or of any remaining credit is excluded. Statutory claims to repayment remain unaffected, in particular in the event of withdrawal, rescission, permanent unavailability of the service, or cessation of business operations.
(4) If the price of a service specified in a service voucher increases, the voucher may be redeemed against payment of the difference. If the specified service is no longer offered, the voucher may be applied at its value toward an equivalent service.
(5) Vouchers can be redeemed on site and during online booking. One service voucher may be redeemed per booking; it is always applied in full to the specified service. Value vouchers may also be redeemed in partial amounts; any remaining value is retained and can be used for future bookings. Via the customer account, several value vouchers may also be redeemed together. For online redemption, the voucher code is entered during the booking process or the voucher is assigned to the customer account — by entering its code or, for vouchers you purchased yourself, directly from the order overview. A voucher automatically noted in your customer account based on your email address can be redeemed on site; for online redemption it is activated by entering its code once in the customer account.
(6) BOOSTER LOUNGE may also issue value or service vouchers free of charge, for example as a prize in a giveaway or as a goodwill gesture. Paragraphs 2 to 5 apply accordingly to such vouchers. Issuing a voucher free of charge does not constitute a purchase contract; there is no right of withdrawal under § 10 and no entitlement to payment or exchange for money. A voucher issued as a goodwill gesture is provided without acknowledgement of any legal obligation. For giveaways, the participation conditions communicated for the respective giveaway apply in addition.
§ 8 Booster Packs
(1) Booster Packs comprise several sessions purchased in advance at a discounted total price. Each session used is deducted from the pack.
(2) The usage period of a Booster Pack is eighteen months from the date of purchase, regardless of pack size and treatment type. Within this period, the included sessions can be booked at the agreed pack conditions.
(3) Booster Packs are personal and non-transferable to third parties. The reason for this is the mandatory, personal screening required before every treatment.
(4) Sessions not used within the usage period expire without compensation. No refund, extension, or credit of the corresponding amount will be granted.
(5) For the purchase of a Booster Pack as a whole, the consumer has a statutory right of withdrawal in accordance with § 10. If the customer has expressly requested that the service begin before the end of the withdrawal period and has acknowledged that the right of withdrawal expires upon complete performance of the contract, the right of withdrawal expires once the service has been supplied in full (§ 356 (5) BGB). If the customer withdraws before that point, compensation is owed for the sessions already taken; the basis of assessment is the proportional pack price per session (total pack price divided by the number of sessions included).
(6) If an individual session paid from the pack credit is cancelled or not attended, the cancellation scale of § 6 applies accordingly. The basis of assessment is the proportional pack price per session (total pack price divided by the number of sessions included). For a free cancellation (§ 6 (1)), the session is re-credited to the pack credit. For a cancellation between 48 and 12 hours before the start of the appointment (§ 6 (2) and (3)), the session is likewise re-credited to the pack credit; only the respective fee is owed, which is charged in accordance with § 6 (8) and cannot be offset against the pack credit. For a cancellation less than 12 hours before the start of the appointment, as well as for a no-show (§ 6 (4)), the session is deemed to have been used and is deducted from the pack credit; this fully settles the cancellation fee and no additional charge is made. In no case will the customer be charged both the pack credit and a fee under § 6 for the same appointment. § 6 (5) applies accordingly; if the customer proves that no damage or substantially less damage was incurred, the deducted session is re-credited or the fee is reduced accordingly. For rebookings, § 6 (6) applies; the pack credit transfers to the new appointment. Within the correction window under § 6 (9), the session is always re-credited to the pack credit in full; § 6 (9) sentence 4 applies accordingly.
(7) The purchase of a Booster Pack requires a customer account; the sessions included are held as credit in that account. If the customer deletes their customer account, sessions not yet redeemed can no longer be booked via the account afterwards. The customer is expressly informed of any pack credit existing at the time of deletion before it takes place; a pack purchase that is still entirely unused may already be withdrawn from in the course of the account deletion for as long as the withdrawal period is running (§ 10 (2)). The right of withdrawal in all other respects (para. 5) and the customer's statutory claims remain unaffected. Vouchers (§ 7) are unaffected by an account deletion and remain redeemable.
§ 9 Loyalty Programme
(1) BOOSTER LOUNGE may offer a voluntary loyalty programme. For every ten fully paid boost treatments, the customer receives, at their own choice, a free service in the form of either a Booster Shot or a Vitamin C Boost.
(2) Progress in the loyalty programme is credited only after full payment of the respective treatment; mere booking or scheduling of an appointment is not sufficient. Treatments paid for with a discount code (§ 5 (5)) participate in the loyalty programme unless the respective campaign provides that the discount takes the place of the progress; this is pointed out when the code is redeemed.
(3) Booster Packs, the personal “Find Your Boost” guidance, and any memberships do not participate in the loyalty programme and do not generate progress. In the case of the guidance, this applies regardless of whether the customer selects, takes, and pays for a boost afterwards.
(4) Accumulated progress does not expire over time.
(5) Participation does not give rise to any claim to a cash payment; the benefit is non-transferable and cannot be settled in money.
(6) BOOSTER LOUNGE may change or discontinue the loyalty programme giving three months' notice in text form. Claims to a free service that have already arisen remain unaffected. Progress already accumulated may still be completed and redeemed within six months after the programme ends.
(7) If a treatment is cancelled or its price is refunded, the progress credited for it lapses. Progress that has already led to a redeemed free service remains unaffected.
(8) In the event of abusive use of the loyalty programme, in particular the systematic booking and subsequent cancellation of treatments in order to obtain free services, BOOSTER LOUNGE may cancel the progress concerned and terminate further participation in the loyalty programme. The customer will be notified of this in text form. Statutory claims remain unaffected.
§ 10 Right of Withdrawal
(1) There is no right of withdrawal for the booking of appointment-based services — treatments as well as the personal “Find Your Boost” guidance. These are services relating to leisure activities for which a specific date is provided (§ 312g (2) no. 9 BGB).
(2) For vouchers and Booster Packs purchased online, the consumer has a statutory right of withdrawal. The withdrawal may also be declared via the electronic withdrawal function provided on our website. Our Withdrawal Instructions apply. This applies exclusively to the purchase of the voucher or Booster Pack as a whole; for individual appointments booked from the pack credit, § 8 (6) in conjunction with § 6 applies.
§ 11 Liability
(1) BOOSTER LOUNGE is liable without limitation for damage arising from injury to life, body or health caused by a breach of duty by BOOSTER LOUNGE, its legal representatives or its vicarious agents, and for damage caused by intent or gross negligence on the part of BOOSTER LOUNGE, its legal representatives or its vicarious agents.
(2) In cases of simple negligence, BOOSTER LOUNGE is liable only for breach of a material contractual obligation (cardinal obligation), and limited to the foreseeable damage typical for the contract.
(3) Otherwise, liability is excluded. Liability under the German Product Liability Act, liability arising from the assumption of a guarantee and liability for fraudulent concealment of a defect remain unaffected.
§ 12 Data Protection
The processing of personal data is governed by the BOOSTER LOUNGE Privacy Policy.
§ 13 Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a consumer whose habitual residence is in another state, the mandatory consumer protection provisions of that state remain unaffected.
(2) Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected. Statutory provisions take the place of any invalid provisions.
(3) BOOSTER LOUNGE is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
